To participate, entrants must meet the eligibility requirements set forth herein
ELIGIBILITY: "Hotel for the Holidays" is open only to individuals who are legal residents of the fifty (50) United States and are eighteen (18) years of age or older at the time of entry. "Hotel for the Holidays" is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. Participant’s personal information will only be used for selection purposes and will not be sold or given to any third party. Limit one (1) entry per person. No purchase is necessary in order to enter or participate in "Hotel for the Holidays". Participants must able to participate in the event January 2nd concluding January 4th 2010. Submission of resume is optional but suggested and will be used for the purposes of helping contestant to obtain employment. Blue Bay Inn agrees to allow potential employers to look at any given resume but assumes no responsibility with regard to a participant’s employment eligibility. The 23 recipients agree to allow there resumes to be posted online and authorize contact by recruiters and other perspective companies with the sole purpose of offering potential employment.
AGREEMENT TO OFFICIAL RULES: Entry constitutes participant’s full and unconditional agreement to and acceptance of the official rules and the decisions of "Hotel for the Holidays", which are final and binding. Winning is contingent upon fulfilling all requirements set forth herein.
TERM: "Hotel for the Holidays" begins at 12:01 a.m. Eastern Time on November 1, 2009 and ends at 11:59 p.m. on December 15, 2009. Entries received prior after the Sweepstakes Term will be disqualified. Blue Bay Inn is the official timekeeper for the "Hotel for the Holidays" Term. All recipients must be able to travel to and from Atlantic Highlands on the January 2nd and departing January 4th 2010. It is the sole responsibility of the recipients for all transportation cost.
ENTRY: To enter you must mail your letter to "Hotel for the Holidays". Letters must include prospective recipient’s name, address, telephone number, e-mail address, a current resume and a notarized copy of proof of unemployment benefits mailed to "Hotel for the Holidays", 51 1st Ave, Atlantic Highlands, NJ 07716. All submissions must be received by December 15th, 2009 and will be drawn during Christmas week. Recipients will be notified via e-mail, telephone and/or US Mail. Participants are required to provide first and last name, mailing address, email address and daytime phone number. There is a limit of one (1) entry per person. Any attempt by any person to obtain more than one entry by using multiple/different mailing or e-mail addresses, identities, logins, or any other methods will void that participant’s entries and will result in the disqualification of that participant.
PRIZES: The accommodation to be given away in the "Hotel for the Holidays" consists of a 2 night hotel stay and admission to a cocktail party for the participant and one guest. The "Hotel for the Holidays" offering is nontransferable and non-refundable and must be accepted as is. No cash or other substitution may be made, except by Blue Bay Inn, who reserves the right to substitute the offering with another offering of equal or greater value if the accommodation is not available for any reason as determined by Blue Bay Inn in its sole discretion.
DRAWING: Participants will be chosen in a random drawing from the pool of valid entries during the week of December 25, 2009. The random drawing will be conducted by one or more employees of Blue Bay Inn or an independent fulfillment entity. Blue Bay Inn will attempt to notify participants by phone, e-mail, and/or written mail within two (2) business days of the drawing. If a participant cannot be located or does not respond within two (2) business days of contact from Blue Bay Inn, the offering will automatically be forfeited and an alternate potential participant will be drawn from the pool of remaining valid entries.
REQUIREMENTS OF THE PARTICIPANTS: Except where prohibited by law, participants might be required by Blue Bay Inn to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within seven (7) days of being notified. If a potential participant fails to sign and return the Affidavit/Release, if required by Blue Bay Inn, postmarked within the required time period, an alternate participant may be selected in his/her place in a random drawing of all remaining valid entries.
GENERAL CONDITIONS: Blue Bay Inn and its affiliates and employees are not responsible for any injury or damage to persons or property including, but not limited to, injury or death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation. Except where prohibited by law, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with "Hotel for the Holidays” or any offering shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New Jersey; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering "Hotel for the Holidays", but in no event attorneys’ fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, entrant’s rights and obligations, or the rights and obligations of Blue Bay Inn in connection with "Hotel for the Holidays", shall be governed by, and construed in accordance with, the laws of State of New Jersey.
